US military judge throws out confessions of alleged 9/11 mastermind citing CIA torture —— A US military judge ruled Friday that confessions made by alleged 9/11 attacks mastermind Khalid Sheikh Mohammed to FBI agents are inadmissible and cannot be used against him at trial, according to The New York Times. The crucial legal decision arrives just ahead of the anniversary of the 11 September 2001 attacks that killed nearly 3,000 people across New York, Washington, and Pennsylvania. While prosecutors had already barred statements Mohammed made following his capture while detained in overseas CIA black sites—where he endured severe torture including waterboarding prior to his 2006 transfer to Guantanamo Bay—the new ruling expands the exclusions. Trial judge Lieutenant Colonel Michael Schrama concluded that Mohammed's subsequent interrogations by the FBI in 2007 at Guantanamo are similarly tainted and inadmissible. Explaining the decision, Schrama cited an "unbroken continuation of the CIA’s psychological conditioning and severe coercion." Furthermore, the judge found that FBI agents intentionally failed to inform Mohammed that he possessed the right to remain silent and to consult a lawyer.
