The Strait of Hormuz is 21 nautical miles wide.
Iran and Oman each claim 12 nautical miles of territorial sea.
There is no international water in the Strait of Hormuz.
Every ship passes through sovereign Iranian or Omani territory.
"International Waterways" is not a legal term. It does not exist in maritime law.
The US has never ratified UNCLOS, the treaty that actually governs this. He's citing a treaty his country rejected, in waters his country doesn't own.
