The US has just imposed more unlawful sanctions on the ICC, this time on its judges. Article 70 of the Rome Statute codifies crimes against the administration of justice & grants the ICC jurisdiction to prosecute these crimes. The US is “impeding, intimidating or corruptly influencing officials of the Court for the purpose of forcing or persuading the official not to perform, or to perform improperly, his or her duties” & “retaliating against officials of the Court on account of duties performed.” The ICC should initiate proceedings against the US perpetrators, asserting territorial jurisdiction via the Netherlands (state party locus of the crimes), every party to the Rome Statute should cooperate in prosecutions and should insulate ICC personnel from unlawful US sanctions, and the Netherlands, under the host country agreement, must ensure the security of ICC personnel and protect the ICC from interference. And decent people everywhere should challenge the crimes of this rogue government.
