The Chinese constitution might surprise you!! More freedom than in the US one...?
1. “批评/申诉 + 机关有处理义务” Article 41 = “Right to criticise government officials and a duty to handle your complaint.”
Yet the US supreme court ruled they don't need to listen or reply! In China there is a public hotline in each city (12345 hotline) that you can call that handles all kind of complaints and they MUST respond to you. A fantastic rule, i use this number a lot.
2. “劳动者有休息的权利” Article 43 = “Working people have the right to rest.”
You might be surprised the US Constitution has no right to rest or paid vacation.. even federal wage law (FLSA) does not require meal/rest breaks or paid vacation.. insane!
3. “保护和改善生活环境和生态环境;防治污染” Article 26 = “The state shall protect and improve the living and ecological environment and control pollution.”
That's why you see how China HAD to clean up. Now the air is really fresh in major cities. Again nothing like this in US constitution to protect the environment.
4. “妇女与男子平等;实行男女同工同酬” Article 48 = “Women enjoy equal rights with men; the state applies equal pay for equal work.”
Women are treated much better here !
5. “年满十八周岁的公民都有选举权和被选举权” Article 34 = “All citizens 18+ have the right to vote and to stand for election.”
Yes, Chinese people vote!!!! There are many votes inside the party and local elections. The US Constitution doesn’t actually state any 'positive' right to vote... rather, it bars certain grounds of denial (race, sex, age 18+).
6. “在年老、疾病或丧失劳动能力时有从国家和社会获得物质帮助的权利” Article 45 = “Right to material assistance from the state and society when aged, ill, or unable to work.”
Fantastic policy, if you dont have a job or too low salary you are given medical insurance in China so everyone can have health care. Good luck in the States!
7. “游行、示威的自由” Article 35 = “Freedom of procession and demonstration.”
Yes protests exist in China, as long as it's organised and the police are aware (same as in the UK btw). The First Amendment actually doesn't actually protect processions/demonstration.
