SUPREME COURT HOLDS AGAINST TARIFFS BEING ESTABLISHED AUTONOMOUSLY BY A PRESIDENT.
I have discussed this on social media several times:
Specifically the unconstitutionality of a president issuing tariffs, and how the Constitution assigns that authority to Congress under Article I.
The only circumstance in which a president could properly exercise such power would be through a treaty negotiation which would have to be ratified by the Senate. That has not occurred here.
Unfortunately, the deeper consequence may be this: when the people do not understand the Constitution and more importantly, why its limits exist the result is growing distrust of the Supreme Court and an escalation of political polarization.
That erosion of understanding is itself destructive to constitutional process and to the indispensable principle of separation of powers.
BOTTOM LINE- This is NOT a loss for Trump. This is a preservation of Constitutional principles and separation of powers.
