FACT CHECK: Israel’s claim is legally incorrect. Yes, Israel is not a member of the ICC and that is legally irrelevant. The International Criminal Court’s jurisdiction does not depend on Israel’s consent or membership. Jurisdiction is based on territory, not membership. Palestine is a State Party to the Rome Statute, and in 2021 the ICC’s Pre-Trial Chamber ruled that the Court has jurisdiction over crimes committed on the territory of Palestine, including Gaza, the West Bank, and East Jerusalem, regardless of the perpetrator’s nationality.

The Prime Minister's Office: Israel is not a member of the Intl. Criminal Court and does not recognize its jurisdiction. The ICC and its prosecutor have arrogated to themselves an authority they do not possess, in a politically motivated attempt to criminalize the Jewish state.
