I would like to confirm to the rest of the world that regardless of what our Prime Minister Keir Starmer says, we do NOT have free speech in the UK
The following legislation regulates, criminalises, and censors all speech deemed “unacceptable” by the authorities:
Public Order Act
Originally created to address riots and violence, this law is now used to criminalise speech considered “insulting” or “alarming.” Even silent prayer in public has led to arrests, especially near abortion clinics, using public order powers.
Communications Act – Section 127
Makes it a criminal offence to send a message online that is “grossly offensive” (to anyone who finds it offensive). The wording is so vague that it’s used against jokes, satire, and dissenting political views.
Malicious Communications Act
Targets messages intended to cause “distress or anxiety” terms that are entirely subjective. Increasingly used to silence criticism or controversial opinions.
Online Safety Act
Championed as child protection, this law gives Ofcom sweeping powers to police the internet. It compels platforms to remove even legal speech if Ofcom deems it “harmful”, or face fines. Even internationally. Ofcom can also refer posters to the police for further investigation.
Counter-Terrorism and Security Act – Framed as anti-extremism, but now widely used to monitor and silence individuals who express views that challenge official narratives, even in schools, (even children), in universities, the NHS, and journalism. There is no fixed legal definition of “extremism.”
Hate Crime Legislation - Including the Crime and Disorder Act 1998 and the Sentencing Act 2020
These laws impose harsher penalties for speech that shows “hostility” based on race, religion, sexual orientation, gender identity, or disability, even when no violence is involved. Intent is irrelevant. perception by the audience is enough.
Police, Crime, Sentencing and Courts Act
Allows for pre-emptive arrests and bans on individuals for speech or protest activity that could potentially cause “serious disruption.” Before they have even done it! Peaceful protest is no longer reliably protected under UK law.
Ofcom and the Broadcast Code
Ofcom regulates TV and radio, and now expands into online content under the Online Safety Act. It decides what opinions can be broadcast and what must be removed, in the name of “harm reduction.”
Equality Act (as applied in workplace policy)
While not criminal law, this Act supports workplace codes used to discipline or dismiss employees for expressing views that conflict with current diversity, equity, or inclusion standards. Many people have lost their jobs for stating biological facts or political opinions.
A New Government Taskforce to Monitor Speech.
The UK has expanded its Counter Disinformation Unit, working to monitor “narrative risk.” A new Home Office taskforce is using AI to detect “trending narratives” online and report posts that may cause “public disorder”, not illegal posts, just ones that challenge the government line.
Proposed law – Expanding “hate crime” laws to include “misogyny” This is expected to criminalise more types of speech deemed 'harmful' to women. (But authorities differ on what a woman is regardless of the supreme court judgement).
Proposed law – A broad “Conversion Therapy Ban”
Still under consultation, but could make it illegal to even discuss certain views on gender or sexuality, including in private conversations, counselling, or prayer.
None of this was voted for by the public. None of it protects our right to speak freely. All of it empowers the state to decide what we are allowed to say. We have state-approved speech, policed by vague legislation, corporate censorship, and unelected regulators.
