This is exactly the same as saying you can't say a murderer is murdering someone and intervene to stop the murder until the murderer has been convicted of murder in a court of law.

... and to date, no competent court has ruled that Israel has committed genocide. Until such a ruling exists, any claim to the contrary is unfounded and misleading.
