"If the Government detained Mr. Mahdawai as punishment for his speech, that purpose is not legitimate, regardless of any alleged First Amendment violation. Immigration detention cannot be motivated by a punitive purpose.

This reasoning also compels the release of Mahmoud Khalil, Rümeysa Öztürk and other students who have been snatched off the street and sent to an ICE prison, and had their visas stripped by Marco Rubio, solely for the crime of criticizing a certain foreign country.
