A leading Israeli law professor, Omer Shatz, warned years ago that the failure by the Israeli courts to prosecute the IDF's war crimes would one day force the International Criminal Court to intervene.
Now Shatz is filing a landmark case at the ICC against Benjamin Netanyahu and six others for inciting Israeli soldiers to genocide.
His case is in addition to the ICC's pending case against Netanyahu and Gallant for crimes against humanity in starving the people of Gaza. Warrants for the pair's arrest have already been issued.
Shatz says that Israel's portrayal of "every Palestinian as inherently complicit, as a threat, or even as a future terrorist justifies such actions as killing women and children. The lack of distinction between Palestinian combatants and civilians legitimizes sacrificing as many Palestinian civilians as necessary to save a single Israeli soldier".
He adds that successfully prosecuting incitement to genocide at the ICC may pave a way for a subsequent finding of genocide at its sister court, the ICJ.
