It won’t work. The genocidal intent case in Palestine does not rely only on inference from conduct (as clear as this is). The world has heard the declarations of genocidal intent with their own ears and seen the genocidal acts with their own eyes. Their argument that Israel’s stated military goals somehow cancel out their declared & manifest genocidal intent is absurd. Genocidal intent can exist alongside other motives. To suggest that military objectives negate genocidal intent would be to imply that the prohibition of genocide effectively does not apply in wartime. But Art. 1 of the Genocide Convention explicitly recognizes that genocide can be committed “in time of peace or in time of war.” Let them blow smoke. There is an unprecedented consensus in the international legal and human rights community. This is quintessential genocide.
